Bet they would at 11pm at night and the guy running through backyards pointing his so called gun.
After killing 9 people, they should have gone ahead and put a bullet between his eyes. As it is now, they'll spend a fortune on a trial and prison for the next 50 years.
A .50 cent bullet would have saved them millions.
If the officer was unable to see the cell phone, and had to rely on the actions of the suspect as he pretended that his cell phone was a gun, then I think the suspect would have been shot. Fortunately, this pathetic little man committed his crimes in broad daylight (rather than by jumping over backyard fences in the middle of the night) so it was easy to distinguish between a cell phone and a gun.
You make a good point though. If police had shot this man, would there be massive protests about police shooting a man with a cell phone? Clearly the protests would have no substance, but that wouldn't stop unemployed, bored people from making a big fuss about it.

Yeah. Reminds me of a situation we had where I live. Some maniac ran out into the street and took a Renaissance Faire type battle-axe to a mother and her little baby who she was walking in a carriage. Hacked the poor kid straight down the skull. When the cops showed up, he still had the battle-axe and they were able to subdue him and take him in.
For once, I really wished they had sent in some of our trigger happy Yahoos that have mistaken a basketball for a gun. ( no kidding, swear to God ) and got away with it.

Quite often the sentence does not seem to fit the crime. In this case, I like the fact that the suspect is alive. Apparently the majority of his victims were female, and he is a pathetic little man who apparently couldn't get laid. I am certain these facts will present problems for him in prison, and a bit of prison sex might be just what a murderous whiner like this needs.
This incident certainly creates a strong argument for a return to making involuntary commitment to mental health facilities moderately less difficult. This tragedy didn't have to happen.
