Whatever the outcome of the retrial, it would be pointless to send him back to prison.

I don't think he meant to cause a contempt of court however he needs to be more careful in future in relation to reporting restrictions.

There will be a retrial due to the fact that Robinson was not given adequate time to prepare a defence properly and the normal course of action in such circumstances would have been to report Robinson to the Attorney General's Office in order that a case could be prepared, whilst the exact breaches in the video were not presented to Robinson as proof of his contempt.

Robinson did offer to take the video down from facebook thereby negating any urgency in relation to a trial, and a similar court case as happened in Canterbury would have been the appriopriate course of action. Lord Chief Justice Burnett was concerned with 'fairness' rather than' illegality', hence the retrial on the basis the proper process was not followed and the process was therefore flawed, and that there was no need to have conducted such a haste trial in the first place.

The Court of Appeal has not exonerated or acquitted Robinson, he is merely out on bail and has strict bail conditions, imposed, he will appear before the Court again for a retrial, and the case against him at Canterbury and subsequent suspended sentence still stand.

It is now for the Courts to look at the evidence again in relation to Contempt of Court and to decide a verdict.

He actually has no restrictions, according to Justice Burnett. He was illegally arrested and convicted.
The counter suit is soon to follow, for false imprisonment. Chief Justice Burnett suggested it, in this injustice he found.

Robinson was given bail on condition that he attended the retrial before the recorder of London at a date to be fixed and keep a distance of at least 400 metres from Leeds crown court.

Robinson was not illegally arrested and in terms of his conviction at Leeds, which he pleaded guilty to, it is now subject to a retrial, at which he may or may not be found guilty.

In terms of the arrest it was in relation to breach of the peace, however he was not charged or sentenced for breach of the peace, and in terms of the Court of Appeal it has asked for a retrial and has not found Robinson innocent.

It also should be noted that Robinson's suspended sentence at Canterbury was upheld by the Court of Appeal, so the suspended sentence still stands.
