"Happened to not pass muster" is quite an understated description of intentionally committing a felony.
D'Souza is far less thoughtful than Michael Moore, and Moore is no great mind. I saw him in person once and watched him waste a couple hours fumbling around and dodging questions in a debate where he was arguing some nonsense about near death experiences proving the existence of god. He's just a pompous know-nothing who is good at getting attention, but who has nothing of worth to say about anything.
