True story. The guy had been robbed before. So he parked his truck away from his house to make it look like nobody was home and sat with his gun loaded, waiting for them. When they broke in, he killed them.
Another poster on this thread mentioned that brandishing, without being followed with a shot, isn't allowed in Florida.
I don't know Florida law but just about everywhere in the U.S. displaying a firearm in a threatening manner, i.e. brandishing, is a crime, unless the brandisher is using his weapon to control a potentially deadly situation. I don't think Drejka would have been charged with brandishing if he had just used his weapon to get McGlockton to back off and had then gone on his way.
Where do you think we're going? Every time a cop does his job the idiots burn half the city down. People are going to take the law into their own hands if they have to.
I live in a liberal hellhole and have no idea what my rights are here, I'm thinking they are something akin to the Soviet Union (Minnesota). We don't have a SYG law here. So in my case, I'm better off hoping the violent animal criminal who belongs in a cage either doesn't notice me or has something else on his mind. Because if I kill him with a gun I'm screwed. If I beat the living crap out of him (which I probably could against most) I'm screwed and probably sued. So in my case, living in a place that hates white males and will automatically assume I had whatever assault coming...I'm better off hoping for the best and doing NOTHING.
This fits the legal definition of SYG, and the sheriff vouching for it would make him be called as a defendant's witness if Fl attempted charges, which it almost surely will not.

Ok, so what if the shover did not physically touch the shooter. What if he came out of the store and started yelling at the shooter as he was approaching him - "back away from my girlfriend or I'm going to kick your ass!" Does the shooter still have a right to shoot him because he feels threatened?
Nope. At that point the shover has done nothing illegal. The shooter has been offered an avenue of safe recourse. When you blindside shove someone ten feet down on the pavement (such a shove would be a rather significant impact, basically a two handed open palm punch), you never gave the other guy a chance to back away.

will go nowhere. Sheriff's comments are critical. Sheriff stated clearly his investigation verifies SYG as applicable.
