But they will or could be brought before a judge, told of the charges and why they were arrested and then released based on conditions (3 months parole or something like that).
Then they'll both know how to deal with these types of conflicts in the future.

He had every right to go after the stolen item. He went overboard when assaulted, but that's hardly a reason for lethal injection death penalty.
