If that same person walked into the bakery and said they wanted a birthday cake (same decoration) do you think he would have refused? Was his refusal due to their sexual orientation or the stated purpose of the cake?

I've never made a tiki torch themed cake before, but I guess I'd give it a try. Baking a cake for someone doesn't turn me into that person.

Flustered? No. I'm just not sure how many times you expect me to repeat myself. The answer was given. The cake was refused because the woman is transgender, not because of the cake design. They were fine with making the cake as a birthday cake. They refused when they found out the party was also to celebrate 4 years since transitioning.

White Nationalists are not a protected class under CO law. Transgenders are as part of the group defined by sexual orientation. You cannot discriminate against a protected class.
They lost because the state commission screwed up. I think even bureaucrats understand how to make things right this time. I am sure they crossed every i and dotted every t.
Won't matter. The CO State commission will still lose. Again. Here's why, from the same-sex wedding cake 7-2 ruling:
"The government, consistent with the Constitution's guarantee of free exercise, cannot impose regulations that are hostile to the religious beliefs of affected citizens and cannot act in a manner that passes judgment upon or presupposes the illegitimacy of religious beliefs and practices"
Two prohibitions there. Cannot impose in the first place, and then cannot act to enforce that imposition.
