This would solve the sticky wicket of separating families. For people that support birthright citizenship when one or both parents are illegal, would should we do? Continue deporting parents and leave the American kids behind, or just let people cheat the system using their reproductive organs?
Did democrats take abortion and gay marriage through congress? So don't tell anyone else it needs to go through congress. Besides even if congress ends birthright citizenship democrats will still go through the courts, so there a good reason to not even bother with congress on this issue.
Sorry, an EO won't do it, no matter how hard you wish upon that star.
I don't know where you get this, but if they have to obey our laws, then they are "under the jurisdiction of". That's what jurisdiction means.
It doesn't. It means under or within the legal framework and processes established pursuant to the delegation of authority by Congress to the Executive.
Since Congress is the SOLE authority to make determinations as to the entire body of law with regards to naturalization, and POTUS is the SOLE authority to exercise and direct his administration's regulatory authority to "faithfully execute" those laws passed by Congress, anyone who has deliberately evaded that process has placed themselves OUTSIDE of the only jurisdiction that exists for determining whether any foreigner should be naturalized or not.
This includes all aliens, illegal or not, born here or not.
It will end up there. Hopefully Trump can replace ginsurg or breyer by then. Can’t rely on Roberts.
Agreed. If they keep checking, they may find that RGB has already assumed room temp.
To me it seems pretty obvious that they were referring to former slaves, not any random visitor to the country. Otherwise they wouldn't have added the line "and subject to the jurisdiction thereof". Had they simply meant to extend citizenship to anyone born here they would have left that out. But we'll see what SCOTUS has to say.
They aren't giving our country/citizens a big MIDDLE FINGER. They want to live in our country. They want to immigrate from where they currently live to our country because they see our country as a desirable place to live and raise children. That's not a big MIDDLE FINGER.
That's irrelevant.
There are literally billions of poor people in the world who would like to live in the United States.
Should we open the border and allow them all to just walk right in and then allow them to have access to welfare and other benefits?

Wow. That’s not even circular logic - because it lacks logical reasoning. The 14th Amendment says what it says, despite how much you might wish it said something else.
I'm guessing he's a fan of the Sessions model: put the children in cages. Maybe they could have separate camps where they will be temporarily kept. "Interned", if you will.
Sorry, but that wasn't Sessions that was Obama that did that. Get your facts straight!
