It's more of an overall question. The OP is asking that if it did happen, for whatever reason, (a possibility since we know he's being investigated) would he, as an ex-president have Secret Service protection in prison?
That's a good question. I'd like to know the answer in regard to any president.
If Obama is found to have conspired with Hillary, the DNC, the FBI, the DoJ and foreign agents to prevent the election of an opposition party candidate by spying on his campaign and setting them up with Dem and foreign operatives, then, failing that, trying to harass him and drive him out of office with fake charges, would Obama and Hillary be sentenced to Gitmo?
If (or when) Trump is tried and convicted would he have Secret Service protection in prison? What about his older children?
He won't be, but if he was, he'd have SS protection.
My best guess. He'll make it through office, and then will face charges when he's done. He'll be pardoned, and we'll put a smudge on this page of our history and then get back to the business of rebuilding our country.
I honestly doubt he'll serve any time, I doubt (and hope he won't) he'll be impeached, I and am ever-so-hopeful that our population will come to our senses and vote this idiot out.
He won't do prison time. He will pardon himself or Pence would pardon him after he resigns or is impeached. So I think realistically Trump landing in prison is as much a fantasy as Hillary going to prison.
State crimes anyone? Ever hear of "dual sovereignty"? It allows states to bring state crimes if the crime was a federal crime that lets say has been pardoned, was committed in that state. State crimes are not pardonable. Under dual sovereignty the Fifth prohibition on double jeopardy doesn't apply if the state charge is in a different state. Now that Cohen has plead guilty for a campaign finance felony among other crimes and has pointed the finger at Trump, rumor has it that the Manhattan D.A. is looking into how the Trump organization reimbursed Cohen. Trump can not pardon state charges against a company or targeted officials. Hmmm who is running the Trump organization? Rah Roe. Given that Allen Wesselberg Trump's long time CFO scurried off to Mueller's office after the Cohen raid, one would have to guess who put the Manhattan D.A. on the trail of the Trump organization.
