RBG will either recover and return to the bench (actual physical presence) , or continue working from home. Either way, the rehearing of Knick v. Township of Scott is scheduled for January 16th. It's a 5th Amendment violation case: the taking of private property for public use without just compensation, in other words... zero compensation. Wonder if RBG will rule for the little guy (or gal in this case, the property owner), or side with the government bully statists.

A SCOTUS Justice who actually abides by their oath to support and defend the US Constitution would have to rule in favor of the First Amendment. Taxpayers, whether local, state, or federal, cannot be compelled by government to fund abortions via Medicaid if their religion forbids abortion.

Personal liberty, or the Right to enjoyment of life and liberty, is one of the fundamental or natural Rights, which has been protected by its inclusion as a guarantee in the various constitutions, which is not derived from, or dependent on, the U.S. Constitution, which may not be submitted to a vote and may not depend on the outcome of an election. Apparently, lefties have concluded that mothers can kill their fetuses, but no one else can. Hence, the multiple feticide laws throughout the US with their consequent prison terms upon conviction. That, in and of itself, is a violation of the Equal Protections Clause.
