Hel! to the no!!

The Supreme Court purpose is to Interpret current "LAWS," not to set up an/or make "POLICY" for the American people. Plus, they have life time appointments to that position and "I" don't want the government to that much power AND not be abled to be voted out of office.

If that was the case, why would we need a President and Congress?? That would be Like having a King and his royal court making all the laws and bypassing the will of the people.

So?

That doesn't require the involvement of the US Supreme Court.

There is no legal cause of action that would ever arise to necessitate the involvement of the courts, except for the possibility of legal challenges to Eminent Domain.

No, the Supreme Court should not take up the issue. It's a budgetary issue. Trump now says he's not going to declare a national emergency because it would be the easy way out, right after he said he would. I've got whiplash.

Nah. Dems just have to admit they aren't acting in the countries best interest right now and swallow their pride. They can't justify themselves to anyone on this issue. They picked a molehill to die on and it's killing the country. Stupid.

The Supreme Court would not be making policy. They would be interpreting U.S. immigration law and precedent to determine whether the U.S. President has the authority to declare a national emergency and override Congress to secure funds to build a Wall to stop illegal aliens, criminals and drugs from coming across the Mexican border.

If Trump declares a National Emergency and uses funds from the Pentagon to build the wall, then the USSC will need to be involved to decide if such a move is constitutional.

The way I view it, it's a win for everyone. The Pentagon doesn't need even a fraction of its current budget, so why not subtract 5,10, or even 25 billion to build a wall? Otherwise that money will go to more drones, bombs, air strikes, and civilian deaths in places like Yemen. Trump gets to keep his signature campaign pledge and look tough. Democratic house members and senators led by Pelosi and Schumer can say they did all they could by their mandate, so the progressive base cannot fault them.

Who loses in such a situation? Even the Pentagon, with its budget somewhere around 700 billion won't really miss that 5-25 billion dollars.

The ACA passed congress but the GOP was withholding funding, quite different.
