Comey knew it was a crime but had to make a Prosecutorial decision that he wasn't supposed to explaining basically "Yea, if you do it, it's a crime regardless of Intent but with Her, we're making this one time exception". He was supposed to throw it back to Lynch who is supposed to throw it to the Deputy AG or even Special Counsel given the conflict of interest since she met with the Target's husband privately for an extended period.
Obama full well knew of the independent, private server. He communicated directly with her there on it, and even had a Fake name to hide his identity. If this investigation actually went through, it would have reached Obama directly.
Obama and Clinton had an agreement for that email server. When the Clintons realized the Super Delegates were going with Obama (they hate each other btw) in 08, Bill being the savvy one basically brokered a deal/convinced Hillary "ok, we'll stand back and support you but we will be running our own show on the side for 2016".
Obama knew he still needed the Clinton Democrats which could have sabotaged his Presidency from the get-go as many in Congress and Washington owed a debt of gratitude to the Clintons. To appease and settle the waters, he offered her the Secretary of State. She was only going to serve 1 term and take alot of credit as part of her Presidential run.
Part of that independent plan for 2016 was a Private Server (With Obama's approval) to run the Clinton Foundation in conjunction with her position as State, as a pay for play (look at how they controlled every aspect of 2016.. from all the SuperDelegates, news organization feeding her questions, DNC. Almost nothing was left to chance except for uncontrollable quacks named Bernie and Trump. They underestimated the role of new media and grass roots frustration). It is well known the Foundation was an open book to bid and to influence policy as well as access. Post her loss, those donations have literally gone down to 0. That's what the Sever thing was all about.
And no way was one little FBI Director going to get in the way of a 16 year plan for Hillary to reach the White House.
