McGahn gave testimony to Mueller’s investigation—not to Congress which has the Constitutional right of oversight on the Executive branch the WH resides in...
Plus McGahn was WH counsel which means is not not Trump or any president’s personal attorney
His role in the WH is to ensure==ENSURE—the rule of law is followed and the president and others in the executive branch do NOT break the laws of the US carrying out their political agenda...

And right now there is NO PROOF that Mueller called a halt to his investigation of his own free will
So far Mueller has not turned in a report to Congress that his origination document called for him to provide listing any time the DOJ prevented him from executing any part of his desired investigation....

Until you see that and Mueller certifies its accuracy then there is plenty of suspicion that Barr (and Trump) stopped Mueller from going forward...
There are active investigations Mueller started that he was not allowed to complete—
The Roger Stone being one, the case against the foreign entity is still in motion, plus the 12 other investigations not revealed but cloaked by redactions...

Whether someone has left the executive branch and is now a private citizen has zero bearing on the ability of the president to claim executive privilege. After all, it is conversations/confidences shared while the person was employed at the White House (not the individual himself) that are privileged.

The three elements of obstruction of justice:

1. There was a pending federal judicial proceeding; - this doesn’t exist.
2. The defendant knew of the proceeding; and - see #1
3. The defendant had corrupt intent to interfere with or attempted to interfere with the proceeding. - where’s the corrupt intent?

You need to read the legal definition of obstruction of justice.

Two points:

1. It's more than a hill of beans. The House will be on record as saying there is evidence the president committed high crimes and misdemeanors. The articles of impeachment will memorialize that. Even if the Senate doesn't vote to convict, it's still a serious stain on the president's legacy.

2. No one knows how the Senate will vote after the House impeaches. If Trump's approval ratings stay in the high 30's/low 40's, the Senate won't convict. If serious new allegations emerge and Trump's approval craters into the 20's, then you'd be surprised how quickly Senators will bail on Trump. Self-preservation comes first for lawmakers.
