He is well known for most of his adult life and with that comes with much scrutiny of him over the years, I highly doubt that he wouldn't have gotten in trouble if he truly was "shady."

Now the precedent has been set. In fact, I don't think that congress can actually do that due to separation of powers. They only have 1 penalty available to them.

And he had more than his fair share of lawsuits. Now that he has tried to raise his profile, those lawsuits come from persecutors who are looking at tax fraud, money laundering and bank fraud.


Not to mention violation of the emoluments clause, for which he will most certainly be found guilty at some point. Anyone who would steal from their own foundation would surely not think twice about screwing over the American people by commercializing his political office.

Your are correct. This particular suit was decided by a three judge panel of the US District Court of Appeals for the Fourth Circuit, which found that Maryland and the District of Columbia lacked standing to bring the suit.



The other outstanding suit was filed by Democratic members of Congress.



Now, one poster claimed that this decision creates 'precedence'. Of course, it does not. Oh, in that particular circuit it does, concerning the ability of the State of Maryland and the District of Columbia in bringing such a suit, but it has no bearing whatsoever on the suit filed in Federal court by members of Congress.



If members of Congress do not have 'standing' to bring a suit against the President of the United States for violation of the emolument clause of the Constitution, then who does?



By the by: the plaintiffs in the suit dismissed may request (but probably be denied, my opinion) for the Fourth Circuit to hear the case 'en banc', meaning the whole court, not just a three judge panel.
