Legally, that changes nothing. The law says she can point that gun at him, and he has to "abandon[] the encounter, or clearly communicate[] to the other his intent to do so reasonably believing he cannot safely abandon the encounter".
If someone is pointing a gun at me, its survival.. no way a jury convicts this guys of murder, the police haters here will be disappointed.
The officer was told to go there, once there he had no idea what was going on inside.. what you are saying goes into department policy on these wellness checks.. what happens if that lady was being held hostage in there and the police department didn't send anyone because they didn't want to trespass???
What would have happened if he had done his job according to protocol, knocked on her door, and asked if everything was ok??? If we're playing hypothetical, I like this one a lot better. She would be alive, and he wouldn't be facing justifiable felony charges. The police chief said we was about to be fired right before he resigned for not following multiple department rules and regulations. Funny how this always keeps coming back to him. Almost as if he's guilty or something?
Oh he's going to see some jail time, just a matter of how much time he will get.
The way his own department has distanced themselves from him, with none of the usual attempts to shield him from prosecution, I'd say it will be substantial jail time.

I wouldn't bet my life on that. A jury of mostly white males probably won't convict him, so it all depends. I don't hate cops, I have two in my family and have friends with them in their family as well. You can criticize cops without being a cop hater.
