There's no need to convince, it's simple fact based on the definition and meaning of words. Always was, still is and shall always be a violation of letter and spirit of the 14th Amendment, the Civil Rights Act, and every "law" we have for people being treated equally.
I am a minority and I do agree that it is institutionalized racial discrimination. However, I do believe there is a place and time for affirmative action. The issue here is when affirmative action isn't placed on a very short term expiration date... and goes on into perpetuity.

As a (mostly) white person who was passed over for a job that went to a radically less qualified POC, yes. And before the haters chime in, I had a relative who worked in the department, worked with the person who got the job and knew that I was far more qualified. She said the person was really bad at the job.
The job was in direct patient care in a large urban hospital and I made the decision that day that I would never trust a health care facility that hired skin color over actual qualifications. If it makes someone feel more virtuous to entrust their health care to skin color instead of skill and expertise, you deserve what you get.
Affirmative Action is the bigotry of low expectations. Affirmative Action is only in place when everyone agrees that certain racial/ethnic groups under-perform others.
