Next time someone vandalizes my property, before I call the police, I'm going to hang a homo flag in my window. So when the police come out to do the report, I can tell them it was primarily a hate crime. Hate crime gets more attention and they try and solve those much faster than if it's just a plain old vandalism situation.
Correct. That's why I can't believe so many people whine so much about the US flag being burned. Who gives a ****? Right?
The reason THIS case is considered a hate crime is because the burning of the flag is meant to be a statement against a type of human. If you burn a cross on a black guy's lawn, sure you're just burning a wooden t, but let's not play dumb and pretend there is no hatred for that group of people behind that action.
by that logic, burning an American flag should likewise be a 'hate crime' since an American is a type of human.
in reality, you have no idea what kind of statement the perp intended - you're just assuming that you do.
He was not charged with burning a flag. He was charged with stealing private property and starting a fire. I do agree that 16 years is excessive and I am not a believer in hate crimes. A crime is a crime.

In addition to stealing and burning the banner, he threatened to burn down a strip club after he was thrown out and had police called on him, and accidentally set fire to a tire while burning the banner.

If it's an attack on a specific person, then it's a hate crime. As a more general political statement, it gets first amendment protection.
