They are looking at the flag as a object or place that resembles a belief and then he set fire to it.

They are equating this to.. ...let's say, setting fire to a mosque. Would you call that a hate crime?

The reason THIS case is considered a hate crime is because the burning of the flag is meant to be a statement against a type of human. It's a hate crime to burn a cross in the wrong place.

If it's an attack on a specific person, then it's a hate crime. As a more general political statement, it gets first amendment protection.

Part of the reason for the long sentence is that he was a habitual offender, and had no remorse for his actions in front of the judge.

Also the church that he stole the banner from offered to help him with his legal bills and to financially support his 3 kids.

Maybe you could take the actual statement from the man that was convicted.

I was replying to someone who was replying to my comment where I already cleared up the burning of the American flag difference
