The problem with Roe v Wade is not that case itself, but the major precedent case it was based on, Griswald v Connecticut. That's what needs to be overturned, not so much for it's effect, but because the legal reasoning behind it is utter, complete nonsense. Google "eminations and penumbras"

Great idea, red states can then put restrictions on birth control as well as abortion.

Does anyone know of another instance of congress so obviously telling the SC how to adjudicate a decision, especially one settled decades ago.

Doesn't seem very constitutional to me.

Yep, to legitimately strike down Roe v Wad, the SC would either have to reject the implied right to privacy in the 14th amendment or dictate that a human fetus is an actual person. Either situation would have huge consequences.

I'm fine with red states making abortion illegal as long as they pay for their own poor single mothers and the resulting children. There will be huge resulting costs. Blue states should be able to refuse coverage should these people try to soak them for benefits later.

Women with money will simply go to another state. Women without money will have the babies on Medicaid, the child will be on Medicaid, they will live off of welfare and food stamps, the child will be on reduced school lunches, they will live in Section 8 housing, etc. Those costs should not be federalized. They should be paid for by the state.

It doesn't really matter though what 60% of the public wants. 65% want marijuana legalized but it isn't going to happen in the foreseeable future. What matters is what the Christian Right wants.

or they'll take matters into their own "hands". Women will always find a way to abort their child because it is their body.
