Sort of like when you are speeding along, 25 mph above the posted limit on a residential street, and you can get off scot-free cuz the police could not show you intended to speed?
Or is it only okay to prosecute people for minor offenses where you cannot prove their intent, but larger crimes where people Rights are violated, you can violate their rights all day long unless they can demonstrate you had intent?
No, more like a cop sees you driving 34 in a 35mph zone on Monday, then on Tues they change the speed limit to 25mph and they pull you over for "speeding" the day before.

Now, a judge can say "It shouldn't have been authorized and I won't allow any of the evidence collected to be used." and that's fine. It doesn't make the surveillance magically illegal.
You are correct, it was authorized when it happened, but only because they willingly, and knowingly mislead the FISA court.
A former FBI wrote a very good article explaining how it is impossible to make the kind of "mistakes" that were in the Carter Page warrant applications. There are too many people that review the applications in great detail, even simple mistakes like grammar, and spelling errors are found, and corrected. It is simply not possible to have 17 major "mistakes" in these FISA applications, it could only happen through a willful decision to do so.
Even the IG stated that when he asked the FBI how these "mistakes" happened, they could not answer these question.
Then whomever "knowingly" misled the FISC judge should be charged. That still doesn't make the surveillance illegal.
Huge development, DOJ ruled that the FISA warrant on Carter Page was not legal.
The DOJ stated in this newly declassified document that there was insufficient predicate to establish probable cause for the Carter Page FISA warrant.
This is a very significant development, the FBI was never justified to conduct surveillance on Carter Page, and by extension, the Trump campaign.
The FBI conducted surveillance on hundreds, if not a thousand or more people, many connected to the Trump campaign/administration for a year without proper justification.
ETA: It seems that 2 of the 4 applicants have been ruled to lack probable cause, and they are still working to determine if the other 2 were properly predicated.
