By the way, OP, we cannot say for sure that the vote was 8-1. Sotomayor was the only justice to publicly record a dissent to the application for a stay, but that does not mean that she was the only one against the stay request. Unlike opinions in merit cases, justices are not required to publicly record votes in applications for stay. All we know is that at least 5 justices were in favor of a stay as it would have taken a majority to issue a stay over the injunction issued by the Court of Appeal. If I had to take a guess, I'd wager that the other three leftist justices were also against issuing the stay, but chose not to publicly identify their position. If this is, in fact, the case, I'd wager that it is so in order to have the decision not appear to be partisan, which it would be more likely to be considered, especially in light of Sotomayor's recent dissent attacking the Court for seemingly favoring the administration with its stay decisions. The other three leftist justices are just as loony as Sotomayor, but they care more about the public perception of the Court than the "wise Latina" seems to.
The fact that this was 8-1 and not 5-4 gives me hope for a ruling on birthright citizenship. Now if only Trump would take action!
See above. You can't fairly read that the decision was 8-1.
Note, some of the stays for the travel ban cases had one or two recorded dissents as well. But we all know how that case ultimately turned out, which was a narrow 5-4 victory for the administration.
