Despite United Airlines promising in an email to keep the middle seats empty, the flight was nearly full. Following the published photo and public outrage, United updated its safety statement, in which it took no responsibilty and bailed out on its previous promise.

In its subsequent feeble statement changing its safety policy, UA said, “We’ll do our best to contact customers about 24 hours before their departure time so they can decide whether to adjust their plans before they arrive at the airport – and we’ll provide this option at the gate, if more than 70% of customers have checked in,” the airline said in a post on its website. In other words, "We may contact you beforehand, but maybe we won't, and you may have an empty seat next to you, but maybe you won't. And when you go to check in after it's too late for you to change your plans, we'll graciously offer to allow you to change your ticket to another flight with the exact same non guarantee."
