Except it was someone else's video used to compose it. "Fair Us" is not very well defined but IMO the use here is no where near the definitions in the law.
When a DMCA take down notice is issued the web site owner needs to comply, if they decide otherwise they themselves could be liable for civil damages. There is process for counter claims with small time period, it can only be put back online if the copyright claimant has provided proof of a lawsuit initiated.
Generally speaking most web sites are not going to ban you for copyrighted content unless it's egregious or repeated. While I don't believe this is Fair Use that is really decision for the courts to decide and web sites should not be involving themselves other than what is legally required of them.
