Here in the State of Texas, even if it is marked Private Property, No Trespassing, you just cannot legally shoot someone on your property.
Now, tell them, not ask them, to leave. At that point they have a choice. Live or die. That goes for LE on your property without warrant, too.

Thankfully, the current armed encounter incident did not involve the use of deadly force.

In your 'live or die' example, would you expect there to be no investigation into the matter?

Please clarify what you mean by quoting the 9th Amendment.

The MO AG has been clear he wants to drop the charges...the question is can the AG do that. And then there may be litigation over it.

So wait a while. It will of course make little difference in my position. I have held right along it is improbable that a MO jury would convict. Be interesting though to see the vote.

Accurate information about this developing story:

Attorney for Mark & Patricia McCloskey files motion to disqualify Gardner, her office from pursuing case

...Patricia and Mark McCloskey are each facing one count of Unlawful Use of a Weapon – Flourishing. The charges stem from a June 28 incident where they were seen pointing guns at protesters who were marching outside of their home on Portland Place heading to St. Louis Mayor Lyda Krewson’s home.

They are scheduled for a first appearance in court August 31st. A hearing date for the Motion to Disqualify has not yet been set.
