No one said it was self-defense or that it was justified. However, the perp didn’t chase the victim. The victim vandalized his vehicle while he was in it. He got out and punched him.

Did szabo wake up in the morning and thought to himself i am going to kill the first guy that bangs on my car? No, right? there you go no intent. One punch law applies.

The sentence is a state law which determines a 1 punch death as a 3rd degree assault- a misdemeanor, unless there is proof the punch was an intent to kill. The jury found Jones guilty of misdemeanor. Nothing to do with the judge or race.

It was Szabo’s behavior that prompted Jones to punch him. Szabo was drunk and there is video of him attempting to pull a mailbox out of his foundation and banging on cars as he waited for an Uber. He reportedly smashed the rear window of Jone’s fiancé’s car.

Jones Got out and punched Szabo and left. Szabo’s head hit the pavement causing brain injury.

Jones had no arrest record and does not drink. He had no idea Szabo was seriously injured, let alone died.

Neither Szabo or Jones are from NY.

Elsewhere under similar circumstances, Jones might have shot Szabo claiming he felt threatened and was defending his property and not faced any charges.

Conversely, Jones could have chosen to call 911 and reported drunk guy damaging property.

Regardless, the Actual outcome has nothing to do with the judge or race.
You give an anti Szabo slant synopsis of the articles.

The WPIX story indicates Jones chased Szabo. You don't chase, approch, and punch a guy if you feel threatened. For some odd reason Szabo's defense team couldn't find Jones' fiance, who was with him in the car. Jones admitted he didn't notice Szabo, until he backed up the BMW to take a parking spot; nothing Szabo did before then matters. I won't even deal with his excuse for fleeing the scene.

I'd like to see a NYS law requiring a one-punch death be charged as misdemeanor 3rd degree assault. This was manslaughter.

Remember when Trump told supporters to take their fist and punch protestors at campaign speeches?

Remember when a crowd cheered when a man sucker punched a protestor at a Trump rally?

Well, every so often a punch can kill someone. Unless it was repeatedly punching someone unconscious I don’t think it’s premeditated murder.

It’s unfortunate but we’ve seen people on advocate for violence when their car was hit or blocked by someone.

The prosecution decided not to pursue more serious charges based on a similar case being overturned.

The law sucks. Race has nothing to do with it.

I just posted a link to the video in my previous post.

The perp got out of his car and ran toward the victim. The victim was stationary at that point but the perp had a decent amount of ground to make up to get to him. Looks like at least 10 yards.

Don't include the judge and jury. They don't decide on the charges. If misdemeanor assault was a lesser included offense option for a jury, then you could ask the jury why it chose assault.
