Remember that logic... If you're doing something illegal, like standing in the street, you can't get mad when you get assaulted.
Driving away from the threat is allowed, get out of the road or at least don't pound on windows if you want to be considered peaceful. If some white dude got out of his car and punched someone "of color" who subsequently died it would be labeled a hate crime and we both know this.
I'd agree that this was not a just sentence. But then again there was no intent to kill here. Is this a greater injustice than a white person of authority killing with full intent a black man running away from him and only getting 20 years in prison? Point is that this works both ways.
He didn't feel threatened. Obviously. How have you not caught on to that fact yet?
Someone was banging on his window. That was all the justification you guys use t defend drivers driving over BLM protesters. Keep that same energy.

Driving away is completely different than running people over, which is what a lot of people on this form we're advocating recently. I'm just asking all those clowns to be consistent. If they want a world where people get to assault people for banging on car windows, then don't be a hypocrite.
this right here is the key sentence. The decedent was out of control and his actions caused another person to react in a way to stop the threat. The defendant could have just driven away but is that the law in New York? The defendant was a basketball coach at some point but was he some type of trained boxer that knew he could knock someone out with a single punch? Misdemeanor conviction is completely fine here. What I take issue with is that everyone here knows that if the skin color of the individuals were reversed this would be spun as a hate crime and the decedents behavior just prior to their death would be disregarded and minimized.

Don't include the judge and jury. They don't decide on the charges. If misdemeanor assault was a lesser included offense option for a jury, then you could ask the jury why it chose assault.
