In reality, if Trump loses, he'll probably resign one day early and allow Pence to become president for 1 day. Pence would pardon Trump. Pence would go on record as the 46th POTUS and Biden would become 47th POTUS.
Are there likely state charges against Trump that Pence cannot pardon?
I would think the attempt to indict would still be applicable even if he did win, just after he is done in 2025.
Or is it moot, because he wouldn't be able to run again anyway, so putting him in jail at that point, nobody would care?
He can be indicted at any time, and tried in absentia if he chooses not to testify. The Grand Juries in New York State and Manhattan don't have to wait. They could indict him before the election.

Fortunately Cy Vance and Tish James are not part of any administraton.
Hopefully, he and the Trump Organization will be indicted by NY State, then he can get his buddy Mr. William Barr to defend him, as he does so well defending him now. My thinking is Barr or any attorney for that matter would want their money upfront, cept for maybe Rudy Giuliani, heck he's been working for him for free for the last couple years.
