Well .. the Senate controls the number of judges. So ... when the Dems gain control of the White House and Senate, they bump the number of judges from 7 to 9.
Not surprising that Dem voters don't know there is already 9 supreme court judges.

This is an arms race that has no good end.
The Democrats shouldn’t have ended the filibuster under Senator Reid. The Republicans shouldn’t have stalled on Merrick Garland. And the Republicans definitely shouldn’t rush this one through and escalate.
What’s reasonable? I think it’s time to propose a Constitutional amendment to address Supreme Court nominations and confirmations to remove some partisanship. Perhaps for Supreme Court confirmations, REQUIRE a 2/3 majority? Perhaps state that nominations MUST be made before 6 months out from an election or after the next Inauguration? Maybe it’s time to talk term limits-really long to remove undue influence but no more lifetime on the court?
If the Democrats do expand I really think they should stop at 11-leaving Republicans exactly where they were prior to Justice Scalia’s death, with a 1-seat majority, which to me is a reasonable compromise. And Republicans should support that and an amendment to clarify the process. Failure in either case will be a telling sign of the maturity of the party leadership, which in both cases is looking about like that of my 9 year old.
The sign of a good neutral solution is neither side gets everything what they want.
How is that reasonable??? And where does that slippery slope end? That is the LEAST reasonable solution.
Oh, so then McConnell and the GOP were wrong when they denied Obama his Constitutional right to appoint successor to Scalia? After all, Election Day was hundreds of days away at that point, instead of just over 40.
The Democrats didn't have the votes to confirm. Obama should have nominated someone less divisive.
