do I think he needs to sue the government for a KNOWN definition that the VP is the one who will declare whom ever the victor of an election.... again NO...he is asking for a ruling on a known and understood (and enforced) law
the point is that the OP's title...based on a twitter post (and also your local news link), wrongfully state the "pence is being sued"... when the fact is that the government is being sued, based on the role of the VP (as the Presiding Officer of the Senate)….so in essence what is being 'challenged' is article 1, section 3, clause 4 of the constitution...…….. its a no winner

actually it lists the VP (in his/her official capacity) as the defendant...… could be anyone including incoming VP Harris....
