Well it is a question of legal epistemology. Trump isn't conspiring against the current government, he is conspiring against the next government which was duly elected but not yet seated. It is a grey area. Sedition requires the use of force. In this case if Trump uses federal officers or the military towards the goal of preventing Biden from assuming office it would clearly be sedition, if not now, then retroactively once his term has ended.
