The guy that video taped the Capitol Police opening the doors and letting people in, is now being prosecuted.
He was not part of the out of control happenings on the other side of the building.
Oh ya, he is also a Republican W. Virginia Legislator, who is a big 1st Amendment auditor guy.
I will admit right off the bat that I did not watch the video but I suspect the issue are the rules that were adopted after the Oklahoma City bombing. After that you could no longer park in front of federal buildings and filming many buildings was also banned because it was feared that the film would be used to assess weaknesses and plan an attack. I remember a number of high profile cases when the new rules were enacted when photographer were getting arrested for photigraphing bridges, etc. I think it calmed down a bit but I suspect some of those rules are still around.

He doesn't say what the charges are. While anyone can shoot video on their phone for personal use, any video taken for use commercially requires a permit in most jurisdictions. I'm in commercial real estate in Seattle and we handle filming licenses all the time.
