How did I miss that?! That is seriously beyond the pale.

Anyway, I don’t think flipping the bird should be illegal to give to a cop. If you want to have some type of legal prohibition on the middle finger, it should apply across the board, not just to cops. And that would be absurd.

Look at Vermont law for disorderly conduct

13 V.S.A. § 1026 under section (3)

It’s a legit citation. ACLU is not going to win this battle.

Well it might be legal, but it would certainly draw some possibly unwelcome attention by the officer. You best be driving legally when you initiate the gesture.

In my hometown, publicly giving the finger to anyone could get you a disorderly conduct charge. I would imagine it would be a certainty if you gave a cop the one-digit salute.

I guess it will largely depend on the laws of the state and policies of the state patrol that will determine if this lawsuit is a waste of time.
