U.S. border agents do not need warrants to search cell phones and computers, they can seize them and do whatever they want

This is the decision of the a federal appeals court !!!

This can take place not just at the border but within the 100 mile zone where 90% of the US population lives !!!

If you are one of the people who put your private life in your phone including banking and financial information it is going to be available to government agents upon demand !!!

Governments right of suspending the constitution marches on and to the tune of the judicial branch !!! The government has citizens surrounded, corralled the population, to feast on their constitutional rights !!! The rights of the federal agents shall not be hamstrung !!!

The American Civil Liberties Union (ACLU) and Electronic Frontier Foundation sued on the travelers’ behalf, arguing the policies violated the U.S. Constitution’s Fourth Amendment protections against unreasonable searches and seizures and their First Amendment free speech rights.

U.S. District Judge Denise Casper in 2019 declined to force agents to have probable cause and secure warrants before searching devices, but she said they must have reasonable suspicion that the devices contained contraband.

But U.S. Circuit Judge Sandra Lynch, writing for a three-judge panel, said basic border searches do not need to be supported by reasonable suspicion and said a warrant requirement would “hamstring” agents at the busy borders.

Federal agents are already given a wide berth to conduct warrantless searches under the “border search exception” (with the frightening caveat that all land within 100 miles of a US border counts as "the border," thereby including nearly every major U.S. city). Adding phones and laptops to the list of things agents can legally search without cause or a warrant is a major blow to the privacy of all citizens.

So much contraband gets thru the border undetected, Im truly surprised something terrible hasnt happened yet!


The amount of drugs coming thru the Mexican border CONSISTENTLY is absolutely staggering! At some point, the border patrol must take responsibility for this...they are either ridiculously ineffective or there is collusion.

We can always get rid of CBP and watch that number of drug/contraband/human smuggling triple or quadruple. El Paso, San Diego, Tucson, and other American border towns can be the next Ciudad Juarez.

While we are at it, we should get rid of police forces in Chicago, Baltimore, Los Angeles, St Louis, etc because there are so many murders in those cities, therefore, police is not doing their job or "ridiculously ineffective" to prevent all the murders.

OP, what is your point? Are you wanting an open border with zero enforcement or inspection?

Yes, Border Patrol Agents, Customs, Border Protection Officers, Immigration and Customs Enforcement Officers and Homeland Security Investigation’s Special Agents can lawfully inspect anything that’s either coming into or leaving the country without a warrant, so what is wrong with that?

Also, it’s not 100 miles, it’s 25 miles from the border. Plus, there are numerous restrictions in place on warrantless searches within that 25 miles limit as well, so the picture you’re attempting to paint is not 100% factual that federal agents and officers are violating American citizen’s Rights or are simply out of control.

Trust me, those officers and agents still need “reasonable suspicion” and “probable cause” to conduct warrantless searches away from an actual land, air or sea inspection port.

Your rights are officially suspended within 100 miles of any US border, but hey its not like you really have them anywhere else in the country thanks to the govt without limits everyone seems to support

Everyone living within 100 miles of a border should submit for a cavity search at least once per month. Most of them are libs, so what it is the harm?
