Good video. So she is claiming no reasonable person would believe what she said while saying she believed what she said. Can you plead insanity in a lawsuit?
The insanity defense is more commonly used in criminal cases.
In a civil case, unless the actor is a child, his insanity or other mental deficiency does not relieve the actor from liability for conduct which does not conform to the standard of a reasonable person under like circumstances.
Is the defamation being treated as a crime here, or as a violation of civil law?

I don't really follow this story, but here's what I know. She filed a ~90 page motion to dismiss.
I'm pretty sure that in 90 pages, it says a little more than that. In fact, I know it does, because regardless of anything else, she's a competent lawyer and would provide multiple grounds for dismissal in her motion. And it's 90 pages.
Don't really care, but since you seem to, you might want to go beyond the headline if you want to be correctly informed about the case. Just sayin'.

I used to rush home from work just to turn on the news to see what was going on. Popcorn and a cold drink.

Most of the Kraken supporters have suddenly disappeared, where are all those legal experts that claimed she was going to save the day with her expertise and her crack team of experts. Now she is lucky if she gets off without being bankrupt.
