Supreme Court rules 9 - 0 against immigrant who was deported for long ago DUI conviction
The Supreme Court made it harder Monday for an immigant to defend himself against a charge of unlawful entry, even though he was wrongly sent out of the country more than 20 years ago based on a DUI conviction.
The ruling will have a particular impact in California because the 9th Circuit Court based in San Francisco had allowed immigrants to win a reprieve from a federal judge if their deportation order was "fundamentally unfair."
The illegal was seeking retro active "justice" He got his dui in 1991. The law wasn't even changed until 1996-7. He needs to hire a lawyer and litigate his case from afar if he wants in that bad.
Isn't that kind of like "unfairly" arresting a drunk driver?
The King County (Washington) prosecutor Dan Satterberg says its "not fair" that illegal aliens are deported after a DUI conviction, so he charges them with a lesser crime so there wont be any notification to ICE. https://www.kuow.org/stories/deporte...ys-s-not-fair/
While I'm skeptical of how far-reaching the opinion actually is considering that it was a 9-0 vote, it appears to be a step in the right direction and another proverbial bench slap of the 9th Circus Court of Appeals.

I'm surprised that Sotomayer was included in the 9-0 decision. She's an illegal alien sympathizer because of her Latino roots.
