If you were born in the last 100 years and not glued to CNN you'd know a "assault weapon" doesn't actually exist. I am completely mind blown how CA has the property rights for hoplophobes. It's like people here never visited other states in the country. It's kinda weird actually. It's almost a slap, well yes it is, to people that served in the military and actually know some minutiae about firearms. Oh, and the Constitution. Whatever. SCOTUS will rule this stupid "assault weapon" thing into history. We can always make up so more stuff in the mean time. How about "death machines", "scary metal bullet lobbers", "Pee my pants on command lead tossers"?

What the hell does drought have to do with the topic Ruth? You are normally way better than this. Feeling ok?

Exactly! Tried to rep you but, CD not allowing it.

Judge Benitez's ruling could not come at a worse time. We currently live in a society wherein mass shootings are a regular occurrence. To cite a source:

"As of May 31, 247 mass shootings fit the Mass Shooting Tracker project criterion, leaving 283 people dead and 1,005 injured, for a total of 1,288 total victims, some including the shooter(s)."

There's no reason for anyone residing in a civil "first-world" society to possess assault weapons such as AR-15 rifles. Violence begets more violence.

Hand wringing aside, this ruling has nothing to do with machine guns so I guess we'll be ok.
If you can't even begin to articulate *what* the state of California deems an "assault weapon", how do you figure your opinion is informed enough on the matter to draw accurate conclusions? Read the laws, then read the decision.

No they aren't and you're connecting dots to two disparate subjects.
Read the law then read the court case.

How many people will have to be killed in this country until we actually see some movement on stricter gun regulations? Obviously, it doesn't seem to matter to many folks (including a lot on this board) that there have been mass shootings in religious institutions, schools, concerts, restaurants, night clubs, workplaces, you name it. But, don't cross them with restricting ANY of their 2nd Amendment rights, because we all know how important AR-15's or thousands of rounds of ammo are to self defense and hunting. Right? Just shows how out of step many Americans are with weighing public safety against their rights. But then again, why should we be surprised when we've seen how much they've acted like babies when it comes to wearing masks or getting a COVID vaccine?

The good news is that the demographic shifts are not in these people's favor and we're seeing more of a collective mindset among the majority of Americans (and growing). On the other hand, the far right are doing everything they can to keep power (including voter suppression, judge appointments, etc.). Will be interesting to see how this battle plays out over the next decade or so.

Eventually, yes. The state's position is untenable in the long term, but in the short, the appeals process is glacially slow. The advantage now vs. the last time this went up the chain to the 9th circuit is after two-hundred years, we finally have a second amendment. When Silveira was being weighed, we were still debating the concept... and that was only twenty years ago. The bottom line is in the absence of Heller, we would've seen a repeat of that this time around because Benitez wouldn't have had the foundational support to issue the opinion he did.



Maybe in another twenty years we'll see substantive changes to these pointless and overly complex state laws regarding phantom issues.

You clearly aren't familiar with the evolution of gun laws in this state. More to your point (weak as it is), on any given day, millions of gun owners in this country don't set out to commit murder.

I never said the majority of gun owners weren't law abiding citizens, did I? Unfortunately, the small percentage who aren't make it exceptionally dangerous for all people in society.

The majority of drinkers are responsible too, right? But, they don't legalize drunk driving because only a smaller percentage of people would partake in this dangerous activity, do they?

I'd like to congratulate the citizens of California. Your civil rights are FINALLY being recognized and protected, at least on this one important issue. Welcome to the United States, hope you enjoy the same civil rights recognized by most of the rest of the nation with more civilized, progressive states. You might want to work on passing Constitutional Carry and join again with the nearly half the country that has recognized the civil rights of their citizens in the last 20 years. CA will likely remain a backwards, regressive state, but this at least is a step in the right direction. Maybe you'll have fewer people fleeing the state for Free America. I certainly see plenty of CA refugees here in Idaho.
