That is consent. Person B consented to getting a BJ from person A. The fact that they didn't bother to learn about person A doesn't change the fact that they consented to a sexual act with person A.
People dupe others into consenting to sex all the time. As long as consent was granted it is not rape. Not doing your due diligence is not rape. Regret after the fact is not rape. Rape has a legal definition that has to do with non consent. IF person B says no, then person A forces a sex act on them then THEN it is rape.
IF you want to go by what a person decides is abhorrent and finds out after the fact then you open the doors to calling all kinds of situations rape. Lied about your income, religion, age, surgical modifications, social standing, past partner count, etc? Under what one may find abhorrent all of those could be considered rape after consent is given. Do you want to open that door?
None of those things compare to forcing a gay conversion on someone. That's initimate and part of someone's identity.
If it is of such great concern to a person that they would kill over it, they may want to make sure they know who they are consenting to receive a BJ from. Regret after finding out the truth doesn't invalidate the consent you gave before and while the act was happening
It's not regret. It's being tricked into sex that is against your sexual orientation.
Deceiving to gain consent is deceiving to gain consent. Some people may consider being deceived by surgical augmentation to be just as bad as you find deception about birth sex. Some may find religious beliefs, social standing, wealth, marital status, etc just as bad. That's the point, either deception to gain consent is illegal in all cases or it isn't. You don't get to decide which deception matters to someone else.
And trans people don't get to decide that it's okay to have sex with someone of the same sex without disclosing.
