Federal Judge Andrew Hanen - A GWB appointee, for those who are wondering - has declared the DACA program illegal and blocked all new applications under the program. However, this ban would not apply to the 635,000 currently protected under the program.

Quote:
Federal judge blocks new DACA applications

A federal judge in Texas ruled on Friday that the Deferred Action for Childhood Arrivals program is illegal and blocked the Biden administration from granting new applications.

The program began in 2012 during the Obama administration to shield undocumented immigrants, who were eligible for the program, from deportation.

Although Judge Andrew Hanen's ruling would bar future DACA applicants, it does not immediately cancel current permits for the approximately 635,000 people protected under the program.
Finally. Trump never did end it as a result of its being illegal, which was a big disappointment. In any case, the ball is rolling now. Now this will hopefully advance quickly to the SCOTUS, where many expect they will put a stake through the heart of this overreaching Obama Executive Order permanently. Let's hope that they do.

Actually, it appears that the declaration of illegality as it applies to current recipients has been declared also, but that part has been stayed until this case works its way through the eventual appeals process. So it appears that all of this is on the verge of being ended.

Quote:
Judge Declares DACA Program Illegal

The decision found that President Barack Obama illegally exceeded his executive authority in 2012 when his administration created the DACA program.

Judge Hanen called the program an "illegally implemented program" and said "the public interest of the nation is always served by the cessation of a program that was created in violation of law and whose existence violates the law."

The order as it would apply to current recipients is "stayed until a further order of this Court, the Fifth Circuit Court of Appeals, or the United States Supreme Court."
BHO will not be pleased.

And neither will the bleeding heart liberals, most Democrats and ethnocentrics who have personal ties to the DACA's. Too bad so sad but its been long overdue. These DACA's and their law breaking parents need to go back home where they belong.

This is fantastic news! DACA was a spit in the face to American citizens as well as naturalized citizens who followed the rules to come here and did not use their wombs to skirt the law.

Why did it take so long to get this ruling. When was the challenge initiated.

Great question. It would have happened faster if Trump had rescinded the Obama EO regarding DACA, but he never did.

As you can see, President Trump did not rescind the Obama DACA EO. It was the acting DHS secretary who rescinded it, and he did not have the authority to do that. Only the President of the United States can do that - and he never did. Never.
