Of course that has never stopped recent presidents from declaring war without congress, but those were with voluntarily enlisted service members. If they tried to draft anyone the courts would never allow it
The Selective Training and Service Act of 1940 instituted conscription in peacetime, requiring the registration of all men between 21 and 35. This law remained in effect until 1946 when further inductions were suspended, and its legislative authorization expired without further extension by Congress in 1947. The second peacetime draft began with passage of the Selective Service Act of 1948 after the STSA expired. The new law required all men of age 18 to 26 to register. Men were drafted every year from 1940 until 1973 except for 1947.

SCOTUS has never ruled "whether a draft of men into the Armed Forces in times of peace is constitutionally permissible." Holmes v. United States, 391 U.S. 936 (1968), was a case in which the Supreme Court of the United States denied a petition for writ of certiorari to a Jehovah's Witnesses minister who asked the Court to decide whether a draft of men into the Armed Forces in times of peace is constitutionally permissible. Holmes was convicted and sentenced to three years imprisonment, and the Court of Appeals affirmed that decision.

The President can't declare war. That power is reserved to Congress. A declaration of was last took place on June 5, 1942, when the US declared war on Bulgaria, Hungary, and Romania.

If that was the case, national security would outweigh the courts.

As divided as this country is right now...its really the perfect time for a foreign nation to come swooping in.

Default Si vis pacem, para bellum

Biden pushing for war?? Don't make me laugh.

He will give away half of our interests in order NOT to go to war. If there is a war, he and his woke puppetmasters know that their dreams of turning the US from an eagle to a pigeon will evaporate as snow in July.

You seem to have a hazy view of history, if you ever studied it at all. If you did, you'd know that the aggressors rarely start wars with the countries stronger than theirs (or they fool themselves that they are the strongest). The wars start all the time when the aggressors perceive a weakness in their potential victims.

So standing firm to China, as President Trump has done, promoted peace, but showing our weakness, like we did in Afghanistan, did not. Neither does choking the Pentagon of the needed funds. It is a sure way to incite aggression in Taiwan.

Russia is similar case. Helping Ukraine is in our interest, to stop Putin's ambitions, but nobody I know calls for sending our troops to the Ukraine. So, no draft in the US.

The ancient Roman dictum has always held true: Si vis pacem, para bellum. "If you want peace, prepare for war."

Russia has a subpar economy and a subpar military. They are not the Soviet Union of old. And we have a Military that has 20 years of combat experience. No draft will be necessary and likely never will again. Technology and Nukes have reduced the need for million men armies. This being said Russia has nukes which is the real worry and only a insane madman would get us into a shooting war with them or any other nuclear power. If we are not attacked nor an ally we have a treaty with it is not our duty to send our children to DIE.

No one is going to get drafted into the U.S. military any time soon. The all volunteer force has worked quite well since 1975. Anyone that supposes such nonsense has no clue how U.S. military personnel are trained in the 21st Century. Thankfully, the days of sending young men to basic training or boot camp and deploying them into a combat zone with little or no following on training are ancient history. It takes roughly six months to train an Army infantryman (11B) and Marine infantryman (0311). Training for other combat arms specialties like artillery, tanks, air defense, Airborne and Rangers take even longer. I can speak from personnel experience that infantry units are very tight knit. There's a lot of tradition and esprit de corps. The men that proudly serve in combat arms units don't want anyone in their ranks that isn't highly motivated and doesn't want to be there.

This is an example of Marine Corps infantry training.

Wonder if those that voted for Biden thought they might have to give their life, or the life of a family member, for him and his administration.
What war? He ended one war already (Afghanistan). It’s more likely that he will end another war (Iraq) before he enters another one.

In researching political party preferences. Republicans are more apt to fund military and benefit from war antics.
Unsure our current President is seeking to engage us .
Have very little understanding of Soviet desire to take over Ukraine. Soviet slumlord style of governing.

Here we have a president who finally got us out of a 20-year-long war in Afghanistan, and yet the right-wingers are hoping he enters another war!

Typical lefty logic in an attempt to deflect from reality and current events. Dems are pounding the table for conflict - they need it as cover for their inept handling of Covid, Afghanistan, inflation, etc. and as an excuse to justify more fiscal irresponsibility. "When all else fails they take you to war".

From what I read, your comment about Russia having a subpar military is outdated. Putin has changed the Russian military that had low morale and equipment that that was poorly maintained. See the article that this quote is from:
