New Mexico has a Democrat Governor.

In NM, the Governor picks the temporary Senator to fill the vacant seat until the next statewide election.

However, a vacancy is unlikely for his seat. Senator Lujan had a stroke last week and is expected to make a full recovery.

If he's in the hospital and unable to travel to D.C., he can't vote on Breyer's replacement. Ergo, Breyer cannot be replaced until he recovers.

He is expected to recover, which means it is unlikely he will step down. The Democrats now are in the minority until he returns…. 50 (R) - 49 (D). No tie breaker needed.

How so? He is a Democrat. The Senate does not allow remote voting. It's 49 Democrats and 50 Republicans without him.
