BUT, its always being collected. the current interpretation, which AFAIK is unchallenged is that unless there is a warrant, no one may actively peruse collected data, except 'bots' of a sort that apply the tracking equally (like cell service to find network 'holes')

And you often give them permission to mine it.
no one reads the fine print or EULAs before they activate stuff. next time, READ all 20 pages of the verizon agreement when you get a new phone, read the agreement when hooking up the smart tv and for gods sake, read the microsoft or Steam EULAs. With steam, you explicitly agree that they MAY install spyware and after clicking yes, if you ever prevent them, YOU are in breach.

PS: decades ago, one of the first things I learned to do with microsofts implementation of C++ was to replace the text in pop up boxes with my own. If you have at least admin accounts active on your PC and you make a system or software change, it will provide a popup asking if you want so and so to make a change. any bad actor can change the text to anything like 'do you like cute puppies' cuz the goal is to get you to click yes, ok, continue etc. All the security in the world is meaningless if you ALLOW THEM.
btw - the fix since, done in C++ and java is to make the method that assigns the text, private. had to expand that to SQL as well so you dont get an injection attack as they could replace your query with a "drop *" or similar evil
