Per the law no, but public opinion people will still hold it against him, they still do in the George Floyd. Won't be long before the "Shouldn't have resisted" and "it's his fault due to drugs" comments that always follow these cases start to appear.

They already have...but the REAL POINT is, LEO should not be drawing Blood,...that should be reserved for Medics who are equipped to handle repercussions should any occur.

The Perp could have been saved with a simple can an NARCAN, if qualified pros were there.

That guy didn't have to die over a DUI....

Same with Floyd,...shouldn't have died over a bad $20.

All they had to do was arrest him, take him to jail, and get a warrant for the blood draw. Why they tried to do it on the street is beyond me.
