In this instance the legal thing is a dodge and you know it. A bunch of left wingers saw the pics as an opportunity to lie and steal a few PR points.

1. Border Patrol agents are not issued whips.
2. Anyone who has ever left the big city for 20 minutes knows that horses are controlled with either a bridal and bit and reins or a hackamore and reins.
