What obviously makes this issue rather difficult to ascertain is the simple fact that neither Russia or Ukraine are members of the ICC , a body which neither country may very well want to join for the foreseeable future in order to save face .
Granted I suppose some other sort of tribunal could be set up to deal with investigating these crimes , but I must digress lest I delve into the realm of utter speculation .
I must say though that it's a great shame that starting unnecessary wars isn't considered a war crime that's fervently prosecuted , since then perhaps we'd see less of all these travesties that are still unfolding time and time again .
