No it is not because the 5 are not consistently conservative while the 3 have their minds made up before the case even reaches the court. Give me an example where Sotomayor or Kagan ever crossed over to vote conservative. Roberts votes liberal more often than conservative on key issues so it is really 5 to 4.



The court consists of 9 members. By your definition of balance, it cannot ever be balanced. You're just upset that it isn't unbalanced in your favor.

The current President gets to choose. That is how it is supposed to work.

The only time I know of when the then-current President did not get to choose was when Mitch McConnell threw a monkey wrench into the process when Obama was President. You probably thought that was fair. I didn't.
because the right are "special" people who never, never do hardly anything "wrong"

For many years (maybe decades?) we had 4 left leaning, 4 right leaning and one who varied depending on the issue. That was a lot more balanced than now.

And yes, 4 of your 5 are consistently conservative. One varies but leans conservative. Very unbalanced these days.
