Both were members of the Ukrainian regular military, serving in the 36th Marine Infantry Brigade,

Aslin joined in 2018, long before the war started.

That makes the men members of the Ukrainian Armed forces and not mercenaries.

If I joined the French Foreign Legion, I would be considered to be a member of the French Army and not a mercenaries.

Similarly Gurkhas and other personnel from overseas who join the British Army and British Soldiers and not mercenaries.

The UN is even warning Russia it is breaking the Geneva Convention in relation to PoW's.

It is however unlikely they will be executed and a swap of some sort in relation to personnel is the most likely scenario.

Russia has violated the Geneva Convention throughout the war. So has Ukraine according to some reports.

In reality they will probably be used as leverage and at some point swapped for Russian military personnel or Russian spies.

This was usually been the case during the Cold War, when Putin's comrades in the KGB were often exchanged.

Russia has nothing to gain by shooting POW's, and such an act would be internationally condemned and may even been condemned by the Russian Orthodox Church that Putin is so fond of. It would also play in to the hands of those plotting against Putin.

Putin won't execute them because he won't want the damaging fall out, and the fact it would give his allies ammunition.

Furthermore they are useful leverage, and you don't throw away your best cards when playing poker.

Putin may be many things but stupid is not one of them.
