If something happened, he's charged; if it didn't, he's charged lesser, or certain charges are dropped. If no arson occurred he obviously can't be charged with arson.

The accused entered into a diversion agreement with prosecutors that was approved by a judge. He did probation and anger management classes. This is pretty standard stuff.
This is the kind of agreement many of the 1/6 rioters are entering into.
So far 306 of the more than 860 rioters that have been charged so far have pled guilty in agreements with prosecutors.
It’s almost like a white man getting VERY sternly yelled at for trying to vote fraudulently, and a black woman asking if she could vote yet, being told yes, and getting seven years.
