Well, I know the legal parameters of the claim.


You stab an unarmed man to death and you have some 'splainin' to do.

Someone claimed he had been stabbed. It sure didn't look like it.

How do you know? Have you been a prosecutor?
1; Yes, it is accurate. Watch the full video and take in how and why the situation escalates.

2: Yes you most certainly can. "Fear of death or great bodily harm" is the catch phrase. I you act on that fear you are acting preemptively. Last I checked you don't wait until some thug is beating you to take defensive action.

3: What did you do then? Just curious. I taught the application and parameters of lethal force. Practical application.

4; The legal parameters for lethal force were more than met here.

5: 'Splainin? The video is self explanatory. A much younger bigger and far more aggressive person was assaulting an elderly far physically inferior victim. In such cases hands and feet are lethal weapons in favor of the attacker. Something I made sure my students understood was just how deadly bare hands and feet can be. There's no explaining needs done here. He was in imminent danger and he acted. End of line.

6; He was stabbed in the arm. It's on the video big as life.

7; No I've never been a prosecutor and I'm not an attorney. One thing I'm not accounting for is that this is lefty lunatic land NYC. Where just like the huge CA urban centers self defense is illegal. You're supposed to let the thugs kill you. Beat you to the ground and stomp on your head. Yes, hand and feet are weapons. There is a law here in NV that clarifies that. Steel toed boots are considered a lethal weapon. Steel toes in general actually since a lot of the bangers here like to wear steel toed sneakers. The victim in this case (the bodega worker) was in legitimate fear for his life.

In addendum it needs to be noted that the attacking thug had an extensive criminal record and history of violence. I'm willing to bet credits to navy beans the girlfriend does as well. SHE should be sitting in Rikers. Not the worker. Sheesh I don't se how anyone can watch the full video (with audio) of this and lay blame on the 61 yo bodega clerk.

That just slays me. No jury OF HIS PEERS is going to convict this guy of murder. The jury would have to be made up entirely of namby pamby urban DAs from CA and NYC for that to happen. That wouldn't be his peers. This is gross over reach and political posturing by the NYC DA.

The DA has decided not to charge her for stabbing the worker.

I can't possible imagine what that DA is thinking.

The outrage people are feeling about this, in NYC and across the country is pretty resounding. Like you say, who is this asshat pandering to? I mean get a grip buddy.

I can't see a jury anywhere in the country convicting that shop owner. Thank god for the video otherwise that guy would still be in Rikers.
