HIPAA violations do NOT require the exposing of a name or address. There are so many things that could end you up with big HIPAA trouble that don't involve a name or address. If the information is enough that someone could reasonably find out the person by the identifiable information, it could be considered a violation. In this case, the doctor released enough information that a case for a violation could be made.

Now, with a HIPAA violation, you aren't going to hear from the AG, it's not really their area. You are going to hear from HSS. If there is one thing that a doctor fears more than their own Licensing board, it is the HSS giving them a call asking them about how they handle their information.

How low can you go in setting the bar for the Indiana AG ? You now acknowledge Bernard filed a timely TPR in Indiana. The AG should at least admit that part of the 'investigation' is over and Bernand complied with the law.

I don't recall, was whether or not she filed a report even an issue before the AG's rant on tv ?

She'd had plenty of time to tell him or the media that she'd filed it, but she didn't. Though, she was very quick to run to the media, without proof, to use that child for political reasons. IF she didn't want this matter discussed then she would have just done the procedure, sent the child home and filed her forms.

Almost nobody gets sent back home that crashes our Southern border. Our corrupt politicians need more future tax payers to feed off of, & that is what this is all about. Parasites needing more future hosts.

and why can't we all leave it at that. This quixotic venture 3 weeks later by one or more to bust the Doc for a HIPAA violation is no more nor less stupid than the fact she ran to the media before she ever filed the report (even though it was filed in time) and then played coy when asked by a variety of people.

I mean, unless we're going have a BUNCH of cases where the "sub-HS year old daughter of an illegal alien is offered up by her mother/raped by mom's boyfriend and they don't figure out she can pregnant until it's too late for their state laws" occurs.

The doctor ran to the media to use this child, with absolutely no proof, to bang the drum about abortions and states laws.

The doctor then clams up when people asked for proof. At least she'd gotten her message out and everyone, including Biden* was talking about it. right?

Since the doctor was still not providing proof, and proof could not be found elsewhere by the media and AG, then the AG spoke up.

Then, the doctor, through her lawyers, spoke up...amazingly the proof showed up the next day.

Then things begin to quiet down about this matter.

Maybe the doctor doesn't like that the story has been dying down, since she once again runs to the media to stir things up. Pushing her abortion agenda and whining about the AG saying mean things about her, because he could find no proof.

Once proof was found, it should have been left right there. Though maybe the doctor should have apologized to the public and to the AG, for running with a completely unvetted story. And, the AG should have apologized to everyone for throwing a fit after he couldn't find proof. And then let it go after that.

But, the rape charges aside, it seems this matter isn't done yet....

He's probably going to claim that the girl consented. In his culture that's normal. He doesn't understand that having sex with children is wrong. The mother doesn't either.

Latin-Americans don't understand the concept of American laws. They commit identity theft, documentation fraud, and then when they get caught they complain, "why are they treating me like a criminal?".

If it is not personally identifiable information, there is no HIPAA violation. She did not release anything that would allow the name of the child to be determined.

Not her responsibility to tell him or the media. She notified the appropriate state agencies.

No proof of what? She commented on receiving a referral from a doctor in another state who could not find anyone to do the abortion there. She did the procedure and filed the required reports in a timely fashion. Note that the report was filed and received on Saturday of the Fourth of July holiday weekend. That demonstrates diligence on her part.
