The worst accusation I've seen come out of the 1/6 hearings has been that he didn't "call off" the protesters when they stormed the capital. I've seen nothing to suggest he directed them to storm the capital, or had the power to order them to not do so. I think of the DOJ tries to charge him with anything, they're going to have a hard time coming up with charges that could stick.
Of course they may not care, and this is just a bald faced attempt to influence the November elections, and keep him from running again in 2024.

2. Contrary to his vows of office, he did not protect the Capitol , the Constitution or the nation
3. He failed to quell an armed insurrection
4. He lied in his teeth about the results of the balloting
5. He was actively involved in finding and submitting to Congress false electors
6. He urged the GA secretary of state to commit vote fraud
plus
He petulantly failed to welcome his successor to the White House.
He put his selfish needs to appear to succeed before the good of the nation.
The 'true believers' make up excuses for all this.

From the evidence I've seen, and the testimony I've heard, it seems like a crime has been committed. But the litmus test will be if the DOJ thinks so. Time will tell.
