The president has absolute authority to make whatever changes to the classified status of documents he likes and may do so any time he still retains the powers of his office.
No, he doesn't need to sign anything, hold a ceremony, make an announcement or anything else.
If the documents were removed while he was still in office, they are declassified by default.
In his zeal to persecute Hillary, Trump signed a law in 2018, making the removal of classified documents a felony. The penalty was changed from one year to five years making it a felony.
LMAO you can’t make this ish up!
It's the best news ever. I LOVE when idiots shoot themselves in the foot.
Guys, it is probably INCORRECT to say he declassified the documents.
He had the absolute right to do so for national security issues. I don't for one second think he actually did declassify documents, but he definitely had the right.
But it's also incorrect to say that there's no room for doubt. Paperwork mistakes happen all the time, and it would be difficult to say that there wasn't a bureaucratic error in implementing his intent.
The FBI carried out several boxes of classified documents from Mar A Lago last Monday, plus the others they took in June. That's a lot more than a few paperwork mistakes.
IF there is proof he declassified those documents, this is a nothing burger as that was his right as President. And if he didnt well the DOJ already established with Hilary Clinton that unless there was illegal intent there is no crime. Remember Comey's big speech on the matter saying the FBI and Justice department found Hilary had Yes broken the law but since there was no intent it was not a crime.....
I think that was before Trump made it a felony by increasing the jail time. Does that intent rule still apply now that taking home classified docs is a felony?
Trump did not personally remove anything. Take it up with his staff. Trump has a secret clearance. He can review/store whatever he wants as long as the are kept under lock and key.
100% untrue. The rules for handling classified material are very specific. Someone with access to classified material can't simply carry it home in a locked briefcase. There are processes that must be followed. Furthermore, having a clearance doesn't allow one to "review" whatever they want. There's something called "need to know". Simply having a secret clearance doesn't allow you to access all secret material.
so every law Congress created that Trump signed is a law "he did" now?
it was FISA Extension, introduced by Orrin Hatch, co-sponsored by 12 fairly evenly split between R & D. Passed the Senate by unanimous consent. R's in the House voted 4-1 in favor, Dems 2-1 against. Then after a minor House Amendment passed 2-1 in the Senate, with 7 R's voting no and 21 Dems voting yes.
Yes it is Trump's law. He signed it willingly. He did not veto it.

He has the authority to change the classification. He still has to get the classified label removed from the document. Otherwise how would anybody know that doc had been declassified?
