This is officially an Idiocracy.
I don't see how they can get away with it. First white/asian family that wants a house, and is in similar situation of having never owned a home before, especially if they're low-income and pay all their bills on time would seemingly win a lawsuit.

Guess it will end up in court like all the other oddly "wrong" things being done
Yes, of course it’s racist. I don’t know how they get away with this with the Civil Rights Act and all. (Oops, Fair Housing - my bad.)
It’s as racist as the job opening I saw the other day that is only open to blacks and Hispanics (or, people identifying as such), followed by the standard EOE statement. Not enough eyes to roll.

It's closing that racial wealth gap we all hear about .
So who is the next group to get preferential treatment? The transgenders maybe?
Am I allowed to refuse to sell to these borrowers?
Nope. That would be "discrimination". See how that works?
And why would you refuse? Going into the transaction, you won't know anything about how they secured their home loan. For all you know, they put 80% down and got reemed on closing costs. You would never know anything except that your home is in escrow and proceeding toward closing.
As for me, it is not my concern how a buyer buys my house, unless it is proven drug money procedes or some other criminal gain. If somebody buys my house legally -- no matter how unfairly entitled they were -- it is legal. I don't get to police the world if a transaction is legal.
Maybe you are saying you are opposed on principal and don't want your home sale to be involved in any way. As I wrote previously, you will never know what details B of A has regarding the buyer's loan unless the buyer is stupid enough to tell you, then it is back to "racism" if you refuse to sell to a minority.

It appears BofA found a use for all those lawyers on retainer.
